I'm planning to go to Dallas this weekend (Sept 16th-18th) to attend the Richard Cornforth Seminar which will be held at the Holiday Inn Select Central.
I'll be leaving Oklahoma City on Friday about 8 a.m. and should get into Dallas in about 4 to 5 hours depending on lots of things I can't foretell. (LOL)
Its about 3 hours 45 minutes actual driving time so not counting possible flat tires or whatever, I'd ought to make it about noon or so.
There is a group supper at the motel Friday night so I'll be attending that as well.
Most of you won't even know I'm gone because I'll be available by phone at all times and I'll be on the internet via cellphone or wireless network at least some of the time.
I'm hoping to meet anyone coming to the seminar or living in the Dallas area that would like to visit with me while I'm there.
Don't know where I'll be staying as of yet. Might not know until I get there. I really can't afford to spend the $89 a night to stay at the Holiday so will probably look for something cheaper than that.

I'm flattered that all of you thought enough about me to take the time out to discuss my article in the October 2004 Maryland State Bar Association Bar Bulletin "When Debt Collectors Call" While you all may feel that I "have my head up my ..." (to paraphase one of your thougts), I would suggest that each of you obtain a law degree, read all of the case law from around the country regarding debt collection and then let's talk about debt collection harassment. In the meantime, please feel free to continue to discuss me and my article. It warms my heart to know that all of you know that I'm out there helping people out from under any of your illegal activities.

I would suggest you start advising your clients to pay their bills in a timely manner. My suggestion to you is that you take a real hard look at yourself and look at the dead beats you encourage. Your article is amateur. You obviously have no experience in this industry. If that's the best you can do I doubt your even a legitimate counsel. I just love attorneys who think they are on top of it, just makes it easier for me and my team two bury them. Seriously try another pastime like personal injury or car sales you ll fit in just perfect.

It may come as a surprise to you, but there is a poster or two here that has a law degree. Having said that, there are people on this forum without law degrees that, because of experience, know more about collection law than 99% of attorneys that don't specialize in this field.
I defended your article because I believe it is legally sound. However, based on your post, I won't defend you as a legal professional.
I doubt anyone here actually believed you had your head up your a## as you suggest. Most likely the belief is your big head wouldn't fit.

One of your fellow debt collectors whose a friend of mine told me about the posts about me (although I'm sure you'll find it hard to believe that a debt collector and a consumer lawyer are friends). I thought I'd take a look. I found what was being said about me entertaining. You guys take yourselves a little too seriously. I'm fine with whatever you think about me - haven't lost a case with an FDCPA claim or wasn't able to obtain a settlement from your brethen yet. I posted a reply for fun. You guys are too uptight. It's almost funny how glaringly obvious the slant of David Cay Johnston at the New York Times has become. (Of course, the New York Times in general has an overall bias that's pretty darn hard to miss.) His "story" about Joe Banister's acquittal starts by saying: "The federal government's campaign against income tax protesters suffered a major setback yesterday..." Aside from his usual dishonest "tax protestor" label, look at the viewpoint of the sentence. The theme was not "man found not guilty." No, that's too pro-Joe. The theme is a "setback" for the United States government. And what does using the term "setback" imply? It implies that Joe was guilty of a crime, but "got away with it." Having an innocent person acquitted would never be characterized as a "setback"; it's called JUSTICE.
Like a good psy-ops fear monger, Johnston wastes no time in mentioning two convictions of OTHER people (referring to Al Thompson and Dick Simkanin). And of course, he had to include the usual vague bashing routine of "The theories [Banister] has put forth have been uniformly rejected by the courts."
Um, why is this story about someone BEATING the federal leviathan mostly about the leviathan insulting and hurting people? Because that's the message Mr. Johnston wants to hammer into the brains of everyone in the country: resistance to Mr. Johnston's god (the federal government) is futile. Of course, what the story SHOULD be about goes directly against that, but let's not let facts and reality get in the way of a good propaganda piece.
And then, just in case Mr. Johnston had any credibility left, he cites that ridiculous "Quatloos" web site as if it's some authority. Hmmm...
he's mentioned me by name SEVEN TIMES in his articles, but NEVER mentioned any of my web sites. Nice "balance." The article also included this: "The verdict stirred concerns that it would encourage more Americans to refuse to pay taxes..." Note the passive tense, and the vague reference.
Stirred concerns among whom? The article is written from the perspective of the government. Hell will freeze over before the New York Times will ever speak of the federal government's terror campaign against anyone with an honest disagreement "stirring concerns" among the people. Why? Because Mr. Johnston has no connection to the real American people, only to those in government.
But at least he quoted Mr. Bernhoft, one of Joe's attorneys, saying that "American citizens have the right to ask the government questions and the government has a duty to answer in good faith." While that is both true, and well said, it's pretty darn sad that we live in a country where anyone needs to state such a thing.
Congratulations, Joe. Mr. Johnston can continue with his self-imposed delusions, but a whole lot of REAL Americans know who the good guys are, and are very thankful for what you have done for all of us. Bless you, and your family.
(P.S. I've been mentioned by name seven times in the New York Times, all in articles by Mr. Johnston, I believe. So why has he said NOTHING about my indictment, and my upcoming trial? He even ran an article about tax-time indictments, but still did NOT mention mine. Why do you suppose he would NOT want attention on our case? On numerous consumer websites, such as quatloos, Uncle Normiecontinues to demand that CREDITWRENCH CEO Bill Bauer answer questions about his teaching in the hope that he might drop some hints or foolishly make some statement that Uncle Normiemight be able to use in his failed efforts to trick or force CREDITWRENCH CEO Bill Bauer to reveal his highly effective methods which defeat the efforts of collection industry personell to extract funds from recalcitrant debtors. Of course CREDITWRENCH CEO Bill Bauer is not going to do that for the simple reason that doing so would immediately negate their effectiveness. If their effectiveness were diminished then Uncle Normieand his cohorts would then be able to resume their donations to and support of so called charitable organizations whose funds are often being funnelled to world wide terrorist groups. Uncle Normiemay very well be such a small cog in the evil machinatons of such groups as Hamas, Al-Quida and many others that he is totally unaware that his activities end up being used for such ends but proof aplenty is available and more is being uncovered every day.

The perpetrators of Cybersmear (or what is referred to as Internet Terrorism), are prone to predictable patterns. Most common among these is the strategy of amplifying a complaint or several accusations in an attempt to lend credibility. This is done largely through what we call “proliferation and amplification.”
The goal of an Internet Terrorist is to inflict harm on the target company or individual. This is done through what must seem to be credible information that also must appear to be large and prevalent.
Here are the consistent tactics of Cybersmearers on-line:
• Anonymous postings on scattered “chat rooms” and/or bulletin boards. • Look for postings chronicling the “injustices” of the accused company in what appears to be detailed “bashing” or techno-discussion. Look for (amateur, unlicensed) interpretation and conclusions. . Look for information or quotes taken out of context from the accused, or represented in very small segments as to be presented in a more misleading manner. • With very few exceptions these basher will claim a concern for “innocent victims” or the “unsuspecting customer”. • With few exceptions these bashers will claim a “neutral” stance, but will solicit either comments or emails which will predominate in the direction of the Smear (this is key to identifying a smear. True neutral discussions open to the public generally occur with both positive and negative viewpoints equally represented. If the balance is tilted too far in one direction, it is the fingerprint of a smear, and the posted comments can safely be considered false). • It is common for all of the comments to be anonymously posted by the perpetrator(s) to create the sense of “unified outrage” or “a virtual stampede of individuals who agree” or “surprising public outrage” (all actual quotes). • Further, perpetrators will anonymously post slightly varying opinions (all in the direction of the smear, of course), so a “discussion” can occur on finer points of the smear, all the while creating the impression of a larger complaint field. • Among what is usually a small circle of smear perpetrators (generally ten or less individuals behind the largest and most famous smears), automatic posting notifications are sent out whenever one individual places new content on the Internet. This allows the others to rush to the scene with their anonymous postings, again, providing amplification and a false impression of the scope of the complaint. • The band of smear perpetrators will carefully interlink their sites (to a controlled result, over linking is punished by search engines) so that their websites receive high ranking in search result pages. • Key words, many times the company or personal name of the accused, will be used in the bashing of titles, body of text, and Meta tags so that someone searching for the accused will automatically find the Cybersmear websites. In this way, the smear is made known to those searching for the accused company or individual. • The smearer’s strategy is to accomplish the following in the mind of the reader: “I didn’t realize all of this about (company or person). I wouldn’t normally believe it, but there is so much of it on the Internet. If it’s that prevalent, it must have some truth to it.”
Cybersmear perpetrators have simply followed the historical basis of telling lies successfully and applied it to the Internet.
Adolph Hitler said, “The longer you tell a lie, the more people will believe it.”
Our Cybersmear enemies know this strategy well, and they will use the above tactics of “amplification and proliferation” to achieve it.
Recently, in an agreement with many credit professionals, Uncle Normie threatened:

Unable to maintain any professional demeanor, even on a message forum, Uncle Normie is only able to resort to harassing threats to support his postions. This is the primary reason he has been banned from all other credit forums on the internet. The secondary reason is his continued insistence on spreading false and misleading information as I have pointed out numerous times on this blog
The courts define harassment as "repeated, unwanted contact from a person or group of people". Uncle Normie's suggestion that he will enlist numerous others to disrupt the current friendly atmosphere of a particular message board, certainly fits the legal definition of harassment.
In recent years, the courts have extended to internet communications, the Federal stalking and harassment statutes including 18 USC § 2261A and 47 USC § 223. In fact, the landmark case of United States v. Young, 1999 U.S. App. LEXIS 32721 (4th Cir. 1999) led to the ammendement of the above statute to include the internet.
Uncle Normie is now treading on very thin ice. The resources of this board run deeper than he might imagine. It isn't confined to a group of scumbags living paycheck to paycheck who's only concern is how to avoid appearing on caller IDs that he is used to. I would imagine that, with little provocation, there are a number of people that would be willing to take appropriate legal action against him for his recent threats.
As he advertises on his website, Uncle Normie advocates suing debtors for violating the law. However, he fails to see how he himself is not above the law.

We've heard the tape and the creditwrench site has prescribed methods of dealing with the collection call. In the real world there are lots of subscribers to the Creditwrench Method but there should be an in house policy for dealing with situations where someone trying to set up FDCPA violations. Deliberate belligerence should be construed as a contrived effort to set up violations a la Lizard King when he made accusations of profanity used against him - the tape of the call was an absolute defense. A reasonable sounding agent on tape complying with statute is the best defense. The main thing is for the collector to keep his or her composure and know when to fold 'em and forward the call to a supervisor. A supervisor then needs to follow the exact letter of the law and send a validation (even if past the 30 day period) with a proof of delivery. Also the address should be confirmed, is this a valid resident address where you can receive formal mail. I don't mean to say all complaints of FDCPA are not valid but the ones where someone is spoiling for a fight and trying to set up violations warrents special treatment. Anytime you hear a debtor asking for the agent's social you know its the Creditwrench Method. This situation and that tape should be incorporated in training. Since Creditwrench was kind enough to give permission to use the recording I would use it to set up an agent for FDCPA violations.
Uncle Normie is a total boob when it comes to blogging or trying to win a battle of wits. He occasionally puts up some new post on his blog illegally stolen from CREDITWRENCH CEO Bill Bauer and imagines that is going to get him some attention in the search engines. He also seems to think that his ignoramusblatherings are going to even be seen by anyone likely to come into contact with Creditwrench or Bill Bauer. In his poor deranged mind he seems to believe that he can somehow win a battle of wits with a blog that has no valid links from anywhere except those he has generated by spamming news groups.
Anyone who happens to run into Uncle Normie or his boob postings should be aware that he is a debt collector and is therefore a member of the collection industry which is well known for being mostly comprised of kooks, sex perverts and a vast array of other types of mentally deranged people who really ought to be incarcerated in a mental institution or prison rather than being allowed to prey on those who have fallen behind on their bills for whatever reason.
It is indeed a great shame that we here in this United States of America do not have the same Unemployment laws that they do in Germany so that members of the collection industry might be put to some more useful purpose.

Proving once again that spammers have little to no conscience, a scam email has been circulating using the death of former British Prime-Minister Margaret Thatcher's late husband, Sir Denis Thatcher, for an identity theft scheme.
Recipients of the fake mailing are told they may be a beneficiary in Sir Denis' last will and testament. According to Sophos
The email, which claims to come from the attorneys of former UK Prime Minister Margaret Thatcher's late husband, claims that the recipient will receive £950,000 in compensation for work they have done helping the less privileged. The email claims that Sir Denis Thatcher collected the money during his long and successful career in business.
In order to obtain the inheritance, recipients are asked to provide personal information such as documents of identification, address, telephone and fax numbers, in accordance with the British government's inheritance law. This latest scam-mailing attempt further illustrates that the majority of scam mailers are despicable individuals who will not shy away from using any disaster, personal or otherwise, to dupe citizens of out identity information, money, or anything they don't want to work for.
Graham Cluley concurs by saying:
"Scammers are constantly trying to dupe computer users into divulging sensitive information with the promise of big money. Using the late Sir Denis Thatcher's name is a sick trick designed to entice the unwary into falling for the scam."
However dreams of big money are not the only motive for scammers to put in their appearances on the internet. There are many other reasons often times not so easily discerned. One example of an outrageous scammer in operation is a fool who often goes by many different screen names such as "Uncle Normie", "Enormis Debtor", "E. Normis" and many other variations of those names. "Normie" is an imbecile who for what ever sick reason goes about the internet setting up blogs and webpages which are spoofs of those owned and operated by reputable business people whom he hopes to discredit. He then uses proxy servers to hide his true IP address and spams all the newsgroups with fake messages which purport to have originated from the company he is trying to discredit.
Beware of this loony criminal and if you see any of his fake messages just ignore them and move on. His spam messages will always refer to a blog he maintains called creditwrench-thetruth but is full of nothing but falsehoods and misinformation.

Debt collectors now spamming newsgroups??I had no intention of bringing up this topic until it was brought up by ANGRY in the comments section complaining about yesterday's spamming of 120,000 newsgroups by unknown party with some agenda or other. The spammer may be a debt collector or attorny who was sued for a bunch of illegal actions in the process of debt collections or lost a valuable case(s) against a well educated consumer or it may be a person who has been hired by a group of debt collectors trying to put CREDITWRENCH out of business for obvious reasons or it may be the owner or moderator of another message forum such as art of credit who is upset by the fact that CREDITWRENCH has publicly exposed their misleading information. The person or organization doing the spamming is using the dingo.1hwy.com anonymous remailer to keep from being caught in their illegal activities. Yesterday that person used the dingo remailer to spam 120,000 newsgroups with messages that look like creditwrench was dumb enough to have been the guilty party. As a result, my new gmail account has been hit with a few complaints from other rightfully angry people complaining about the abuse. The guilty party uses a wide variety of screen names such as "Uncle Normie", "Enormis", "Enormis Debtor", "ISO More Credit", "Normie", and others to post on various forums such as www.collectionindustry.com, artofcredit.com, www.pcmholdings.com and maybe others as well. He also has a blog which uses the crediwrench name to libel and defame but is full of misleading information. The person calling himself "Uncle Normie" hopes to get a lot of attention for his blog by spamming newsgroups and threatens to do it every day, however a search seems to indicate that only about .000777 percent of his spam messages actually remained on the newsgroups. Those few groups where they did stick are newsgroups that do accept spam and have no moderators to stop the spam. Spammers post all manner of sick stuff there thinking people might see it and buy their little blue sex pills, visit their porn websites or buy into their gifting clubs hoping to get rich overnight. Spamming newsgroups and trying to blame the results on CREDITWRENCH is exactly the kind of shady tricks that debt collectors would be likely to use. It is also the kind of shady tricks that might be used by the owners and moderators of dumb tricks inventors to be found on such message boards as art of credit might use. They want to claim that CREDITWRENCH is a credit repair organization in spite of the fact that CREDITWRENCH has never attempted to repair anyone's credit and never will. CREDITWRENCH teaches that credit repair is easy to do and one does not need to pay anyoone to do their credit repair for them. CREDITWRENCH also teaches that such messge forums as artofcredit, creditnet, creditboards and others may teach how to "fix" one's credit but fail to teach the fact that "fixing" one's credit only works about half of the time if that. They also ignore the fact that one's credit score has no bearing upon whether or not a defaulted creditor or their debt collectors will file a lawsuit against you thereby ruining all the work and effort you put into "fixing" your credit. Bills Making It Harder to Erase Debt Set to Clear Congress Republican leaders in Congress began clearing the way yesterday for swift passage of legislation backed by the credit card industry and opposed by consumer groups that would make it harder for consumers to wipe out debt through bankruptcy.Congress has tried repeatedly in recent years to pass similar legislation in what would be the most significant change in bankruptcy law in more than a quarter of a century. Twice in the last seven years, bankruptcy bills have passed both the House and Senate, only to face ultimate defeat. In one case, President Bill Clinton refused to sign the legislation, saying it was unfair to consumers. In 2002, House Republicans initially backed the bill but then voted it down after an amendment was attached that sought to prevent individuals from using bankruptcy to shield them from fines imposed for illegal antiabortion protests.Now two nearly identical bills have been introduced in Congress in the last week that are essentially the same as what House and Senate negotiators worked out in the last Congress, but lacking the controversial abortion amendment. The absence of the amendment, plus the Republican leadership's decision to begin deliberation now, early in the legislative cycle, has industry officials and lawmakers hoping a bill can become law within weeks."The timing of bringing it up now, that's a critical difference," said Edward L. Yingling of the American Bankers Association. The Republican majority in Congress has had the votes to overcome opposition but until now lacked time to combat the procedural delays opponents have used to stall the legislation, he said.Lobbyists for the credit card industry say the legislation is needed to close loopholes that make it too easy for people to wipe out their debts when they could repay some of them.Consumer advocates say it would allow some rich debtors to continue to hide wealth through homeownership while bankruptcy relief would be denied to many people with low or moderate incomes who have fallen on hard times because of illness, job loss or divorce. They say credit card companies must share the blame for increased bankruptcies because they aggressively market products and inadequately disclose how interest rates and penalty fees mount up. For example, eliminating a $1,000 credit card balance paid off at a rate of 2 percent a month and carrying an interest rate of 17 percent would take 88 months, or more than seven years."Our overall concern is that this isn't a balanced bill," said Travis Plunkett, spokesman for the Consumer Federation of America, a nonprofit consumer research and advocacy group. "There isn't a single curb on abusive lending practices by credit card companies in these bills."He said he finds the industry's claim it needs bankruptcy reform puzzling because credit card issuers "continue to offer credit to Americans in record amounts" and have reported, as a group, one of their most profitable years in more than a decade.Jeff Tassey, a lead lobbyist for the financial industry, said the companies he represents know health-care costs and divorce contribute to many bankruptcies, but he disputes they are driving factors. If medical costs were to blame, bankruptcy rates would not fluctuate so wildly around the country, he said.Under current law, individuals filing under Chapter 7 can wipe out their debts if they agree to give up most of their assets, excluding in most cases their house and other essentials. They do not have to prove insolvency, but a court can deny them bankruptcy status if a judge thinks the law is being abused.The American Bankruptcy Institute, a nonpartisan research and education organization, says about 3 percent of people who file under Chapter 7 could afford to repay a portion of their debt under a court-supervised plan if they filed under Chapter 13, which requires some payment. Lobbyists for the credit card industry say the figure is closer to 10 percent.Under the proposed law, those filing for bankruptcy would have to undergo a two-step test outlined in a formula that permits judges little leeway. It would force an estimated 30,000 to 100,000 people a year who now seek protection under Chapter 7 to instead make some repayment under Chapter 13.The legislation would make it harder for, but would not eliminate the ability of, wealthy people to hide assets during bankruptcy by buying expensive houses in states such as Texas or Florida, which currently provide broad exemptions for homes.And it would require more disclosure by lenders about the pitfalls of paying minimum balances, though far short of what consumer groups and Democrats had pushed for.Lenders would have to provide toll-free telephone numbers where consumers could get more information about how long it would take to pay off a bill by making minimum monthly payments. They also would have to include printed information in monthly bills warning customers of extra costs incurred by paying minimum charges. The credit card industry killed efforts to force companies to disclose exactly how much extra interest consumers would pay."This legislation eliminates some of the opportunities for abuse that exist under the current system," Sen. Charles E. Grassley (R-Iowa), the chief champion of the bill, said yesterday during Judiciary Committee hearings.Chairman Arlen Specter (R-Pa.) said the committee will vote on the bill next week. It will then go to the full Senate for a vote. House Judiciary Committee Chairman F. James Sensenbrenner Jr. (R-Wis.) introduced a similar bill yesterday. He has said he will wait for the Senate to act before proceeding. It has come to my attention that members of Britain's elite Special Air Service -SAS- have undertaken reconnaissance missions inside Iran alongside units of America's secret Delta Force. British Prime Minister Tony Blair has cast a veil of secrecy over that fact because, unlike his American allies, Blair has toed the European line that dialogue with Iran is preferable to Confrontation. The SAS, whose motto is "Who Dares Wins" is regarded as one of the most professional special forces organizations in the world. During the first Gulf War they operated deep inside Iraq to destroy Saddam Hussein's scud missle batteries. BRAVO, TWO, ZEROOne of their operations codenamed "Bravo, Two, Zero" was later made into a movie. In the operation, an eight-man team was sent into Iraq but four were captured and three killed. Those cptured were interrogated and tortured by Iraqi forces. The recent missions inside Iran were carried out following a request from the Pentagon because the SAS has had more operational experience in the Middle East than any other Western Special Forces group.Why would they be there if we are not headed for yet another war in the Middle East? The same rhetoric about nuclear weapons seems to be the excuse that is currently being bandied about as a supposedly plausible reason why we must consider an invasion of Iran. The problem of online attacks by one business attempting to discredit their competitors is becoming more and more prevalent as competition for the consumer dollar grows.
Online enterprenuers sometimes attempt to discredit competitors for any number of reasons but although their attacks can cause some temporary damage their chickens always come home to roost and their efforts usually backfire on them one way or another for the very simple reason that they usually do not understand the mechanics of search engine marketing nor of search engine optimization.
Webmasters who do understand such things will always win out over a competitor who has no such understanding or knowledge and as a result do not understand that when they engage in their nefarious tactics they usually do not realize that a consumer's reaction to all the negativity is not only to avoid any contact with the naysayer but also tend to go to the target's website to see what the ruckus is all about.

While those kinds of things might seem logical to those not well grounded in good marketing concepts, they are nothing but time wasters.
Trading links with other websites and blogs can also be a trap because the blog you trade links with needs to be high quality links that have relevancy to your website and your theme whatever that might be. You also need to check the link on the other blog that trades links with you to see where he has put your link and how he has formulated the html coding. If the other blogger or website puts you on a separate page full of other links which in net effect constitutes a link farm it will do you more harm than good.
